feasible to entertain the possibility of providing the extra

cost, than they are at present. In these circumstances it is

improbable that the Secretary of State would reconsider the

question, and reverse his previous decision (given in July,

1906, and again repeated in October, 1906) unless some new

causes had arisen, nor could I recommend him to do so with the

data before me.

It is not alleged that between that date

and the present there has been any abnormal increase in the

work of the Courts, and I gather that the only new factor

consists in the departure of Mr. Justice Wise. Meanwhile the

difficulty as regards cost has increased owing to the financial

depression. Your Honour has told me verbally that were an extra

Judge appointed it might reasonably be anticipated that from

half to two-thirds of his salary would be provided by increased

fees of Court. Admitting this to be so (and I have myself no

knowledge by which to gauge the proportion) less than one-third

of the total cost to the Colony would be met, when the con-

-sequential increase of Subordinate Staff, accommodation &c.
